Jury Deadlocked In Crash That Killed Cyclist

A jury fails to reach a verdict in a 2009 crash that killed a bicyclist. Get the latest.

A Franklin County jury could not reach a verdict on Monday in the case of a man who allegedly drovedrunk, striking and killing a cyclist.

Edward Miller is accused in the 2009 death of Stephen Barbour, who was struck whileriding a bicycle along Cemetery Road in Hilliard.

Barbour 58, died four days after the crash, 10TV News reported.

Miller was charged with aggravated vehicular homicide.

Prosecutors allege that Miller was drunk when he struck Barbour and later failed afield sobriety test.

Miller's defense attorney questioned the accuracy of the sobriety test, and saidthat Barbour, an avid cyclist, was wearing dark clothing and did not have lights installed on hisbicycle. 

A former Columbus television news anchorman was among the witnesses called totestify. Gabe Spiegel testified that on the night of the crash, he and Miller had been out forabout five hours and gone to at least two bars, including a gentleman's club.
