Former Ohio State University Buckeye football player Bradley Roby is facing an OVI charge.

Court documents show that the incident occurred on April 20 and a report was filed on April 22.

Columbus police tell 10TV officers were dispatched to Vine Street on a report of a person passed out behind the wheel of a car.

When officers arrived, they were unable to get the driver's attention. They opened the unlocked door and say they noticed the odor of alcohol.

Police say another officer was called to conduct a field sobriety test, which the driver failed.

Roby's agent, Michael Perrett disputes the police allegations.

In a statement, Perrett says, "Bradley was sitting in his parked car in a parking lot when he was approached and questioned by an officer.  He was fully cooperative and willingly submitted to field sobriety and breathalyzer tests.  His BAC test registered a negligible .008 and after further testing at the police station, he was very quickly released on his own recognizance.  There are no other charges, and we are confident that this matter will be resolved quickly and favorably for Bradley."

Roby, a star defensive back, left Ohio State at the end of his junior season to enter the NFL draft which occurs in early May.

Roby was suspended at the beginning of his junior year after being involved in a bar fight. Charges in that case were dismissed.

On Friday, Roby's case was continued until Tuesday, April 29 when he is scheduled to appear in court, according to his attorney.
