A man has been sentenced to five years of probation for inappropriately touching a girl in the wave pool at Zoombezi Bay.

Thirty-four-year-old Philip Lohbauer had entered an Alford plea to one count of gross sexual imposition. In an Alford plea, a defendant does not admit guilt but admits the evidence against them would likely result in a guilty verdict.

On June 18, 2018, a girl notified Zoombezi Bay staff that a man was touching her inappropriately in the wave pool. The staff called the Delaware County Sheriff's Office and Lohbauer was placed under arrest.

Lohbauer is also required to register as a Tier 1 sex offender and was sentenced to 180 days in jail with credit for 25 days already served.

The remainder of his jail sentence may or may not be enforced in July based on counseling that Lohbauer is ordered to attend.

Additionally, Lohbauer was ordered not to have contact with the victim and is barred from Zoombezi Bay or any other water park.
