CINCINNATI (AP) — A Cincinnati-area abortion clinic has filed a second lawsuit asking a judge to order the Ohio Department of Health to approve its license.
The Lebanon Road Surgery Center of Sharonville filed the lawsuit Tuesday in a Hamilton County court.
Attorneys accuse the department of abusing its regulatory authority by ordering the clinic to close in January after questioning whether it had followed rules to provide backup care for patients.
The clinic says proper backup care always has been in place, and that the department ordered the closure for political and arbitrary reasons.
Clinic attorneys say the latest lawsuit is procedural and hope to consolidate it with an earlier lawsuit over the same matter, which is scheduled for oral argument Friday.
State officials declined to comment, citing the pending litigation.
