Southwest Ohio man charged with raping 12-year-old

CINCINNATI (AP) — A 21-year-old southwest Ohio man has been charged with raping a 12-year-old girl two times, once after giving her marijuana.

Lavelle Ausberry Jr. of Springdale pleaded not guilty Thursday to two charges of rape and one count each of corrupting another with drugs and breaking and entering.

The Cincinnati Enquirer reports ( that Ausberry's attorney told Judge William Mallory in court Thursday that the 12-year-old led his client to believe she was of age. He also disputed that marijuana was involved.

Mallory said he didn't understand how someone could mistake a 12-year-old for an adult and denied a request to release Ausberry under the condition of house arrest with an ankle monitor.

Mallory set Ausberry's bond at $800,000.

His attorney did not return a call for further comment.
