Kerry Kennedy fights NY drugged-driving charge

WHITE PLAINS, N.Y. (AP) — Kerry Kennedy's lawyer says the drugged-driving charge against her in New York should be dismissed because it was only by accident that she took a sleeping pill before driving.

In a motion filed Friday, attorney Gerald Lefcourt also says the only harm done was to Kennedy's pride and her good name.

Kennedy, ex-wife of Gov. Andrew Cuomo, was arrested in July after police said her Lexus swerved into a tractor-trailer on Interstate 684 near her Bedford home.

Tests found a small amount of a sleeping drug in Kennedy's blood. She said she believes she accidentally took a sleeping pill instead of thyroid medication.

In the motion, she says she would never drive after knowingly taking the drug.

A Westchester County district attorney's spokesman would not comment on the motion.
