Ohio high court asked to hear bathtub case appeal

CINCINNATI (AP) — A southwest Ohio man seeking his fourth trial in the 2008 bathtub drowning of his wife is again asking the Ohio Supreme Court to hear an appeal in his case.

The state's highest court last week declined jurisdiction in Ryan Widmer's appeal of last year's ruling by a lower court. That appeal contended police improperly removed the couple's bathtub as evidence from their home in Warren County.

Widmer's latest appeal to the court focuses on DNA testing his attorneys said should've been done on Widmer's wife, Sarah. They say she showed possible signs of a genetic disorder that could have caused her to drown. The filing Wednesday says the case involves substantial constitutional questions.

Widmer is serving 15 years to life in prison for his 2011 conviction.
