Mo. man to be freed on bond before murder retrial

Friday February 15, 2013 10:45 AM

PLATTSBURG, Mo. (AP) — A Missouri judge has ordered a man convicted in his neighbor's 1990 murder to be released on bond pending a retrial.

Platte County Circuit Judge Owens Lee Hull Jr. on Friday ordered Mark Woodworth released on $50,000 bond.

Woodworth is awaiting his third trial in the 1990 fatal shooting of Cathy Robertson. He was 16 when the wife of his father's business partner was killed.

Robertson's husband Lyndel Robertson survived the attack in their rural home in northwest Missouri.

Hull's order comes after the Missouri Supreme Court ruled in January that state prosecutors failed to share evidence with Woodworth that could have helped his defense.

Woodworth was first convicted in 1995. He was then briefly released on appeal but convicted by a second jury four years later.
