LEBANON, Ohio (AP) — A southwest Ohio man accused of shaking his fiance's toddler son into a vegetative state is going to be tried again after a jury failed to reach a verdict the first time.
The Dayton Daily News (http://bit.ly/VvBS4r ) reports that 30-year-old Jason Milby will face another trial beginning Monday. A Warren County jury couldn't reach a verdict after eight hours of deliberations in June.
According to trial testimony, Milby was babysitting the then-2-year-old boy and two siblings in July 2011 when the child suffered "neurologically devastating" injuries. The boy now cannot walk, talk, feed himself or see.
Milby is charged with one count of felonious assault and two counts of child endangering. His attorney contends the child suffered tumbles and accidents that could have caused the injuries.
