NEWARK, N.J. (AP) — A New Jersey appeals court has ruled prosecutors may use blood test results from a car crash involving a state police detective.
Monday's ruling reverses a judge's decision that found the state waited too long to file the subpoena.
According to court papers, William Billingham was driving on Interstate 295 in 2009 when he rear-ended another vehicle, causing it to flip over.
Prosecutors didn't seek blood tests from the hospital that admitted Billingham until months after the accident, after they received an anonymous letter saying alcohol had been involved.
The state concluded Billingham's blood-alcohol concentration was above the legal limit. He filed to suppress the blood test results after being indicted in 2011 on one count of assault by auto.
Billingham's attorney says he's reviewing whether to appeal Monday's decision.
