Court turns down OH nursing home's appeal in death

CINCINNATI (AP) — A federal appeals court panel has ruled that a northeastern Ohio nursing home was liable for the death of one of its residents after giving her diabetes medication she didn't need.

In its ruling Wednesday, a three-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati denied The Landing of Canton's appeal of a jury's decision finding them liable for Dorothy Freudeman's death.

The judges wrote that evidence at trial showed that the home "consciously disregarded the rights and safety of its patients with a great probability of causing substantial harm."

The home did not immediately respond to a request for comment Wednesday.

Freudeman was found unresponsive in 2007 after it's believed she was inappropriately given diabetes medication, causing brain dysfunction, diminished quality of life, and ultimately, death.
