Ohio teen's father sues school board over assault

HUBER HEIGHTS, Ohio (AP) — The father of a 14-year-old Ohio boy who said he was assaulted by upperclassmen at his high school is suing the school board and two of the alleged attackers.

The Montgomery County man filed a lawsuit against the board of Huber Heights City Schools and the two young men on Oct. 12.

The lawsuit says that in 2010, four upperclassmen cornered the teen, and two of them assaulted him in a sexual way. The suit says the attackers — who were on the baseball team — described it as a hazing ritual.

The suit accuses Wayne High School of knowing about the ritual and showing deliberate indifference by failing to act.

Huber Heights Superintendent Susan Gunnell didn't immediately return a call for comment Thursday.
