Family of NJ assisted living resident sues home

WHIPPANY, N.J. (AP) — The family of a New Jersey Alzheimer's patient who say she was killed by a fellow resident at her assisted living facility has filed a lawsuit.

Attorneys for the family of 85-year-old Rita Ellinger say she had complained to staff members at Arden Court in Whippany of a fellow resident she said had been threatening and stalking her.

The suit claims staffers instructed Ellinger to avoid the man by using a different corridor.

The suit alleges Ellinger was attacked by the man in October 2010 and died days later from her injuries.

The injury and wrongful death civil suit was filed Wednesday in Camden County Superior Court.

A message left Thursday for Arden Court officials was not immediately returned.
