Padilla to be resentenced Dec. 3 in terror case

MIAMI (AP) — Convicted terrorism plotter Jose Padilla will be back in Miami in December to receive a new prison sentence after an appeals court said he deserves more time behind bars.

U.S. District Judge Marcia Cooke on Wednesday set a Dec. 3 sentencing date. Padilla could get life in prison.

The 41-year-old Padilla was sentenced to 17 years in prison after he and two others were convicted in 2007 of several terrorism-related charges. He's currently scheduled for release in January 2022 with time off for good behavior.

The appeals court ruled Padilla deserves a longer sentence because he trained to kill at an al-Qaida camp in Afghanistan and had a long criminal record previously.

Padilla is currently being held at the Supermax federal prison in Florence, Colo.
