Columbus Used Car Dealership Part Of Ohio Attorney General Lawsuit

UPDATED: Monday June 10, 2013 3:37 PM

Ohio Attorney General Mike DeWine announced on Monday that he filed lawsuits against Buyers Choice Cars of Columbus and Boasko’s Rt. 4 Automall LLC of Sandusky.

DeWine charged the used car dealerships in addition to their owners with violations of Ohio’s consumer laws.

He is seeking full reimbursement to the Title Defect Recision (TDR) Fund, according to the AG’s Office.

The AG’s office said that Buyers Choice Cars, located at 4720 N. High St., failed to provide titles to consumers within 40 days of the sale.

The Attorney General paid a total of $19,415.52 from the TDR Fund to resolve consumer complaints.

According to the lawsuit, the dealership and its owner, Robert Cordell, are being charged with violations of Ohio’s Certificate of Motor Vehicle Title Act.

Boasko’s Rt 4 Automall, located at 3002 Hayes Ave. in Sandusky, failed to transfer titles as required by Ohio law, according to the lawsuit. The Attorney General issued out a total of $37,465 from the TDR Fund to help resolve 17 consumer complaints against the business, according to the lawsuit.

The dealership and Stacey M. and Marc L. Boasko, who ran the business, are named as defendents.

"In order to drive a car legally in Ohio, you need a title," DeWine said in a press release Monday. "And when a used car dealership fails to timely deliver that title, we can step in to help. In this case, we paid out more than $56,000 from the Title Defect Recision Fund to help consumers who had title problems with these dealerships, and we are filing these lawsuits to recover that money."

Administered by the Attorney General’s Office, the TDR Fund was established to offer refunds to retail purchasers after motor vehicle dealerships fail to provide a valid certificate of title in their name within the required period of time, according to the department.
