Husband, Wife Convicted In Sons’ Deaths Get New Trials

An appeals court in eastern Ohio has overturned the convictions of a woman and her husband in the drowning of her 3-year-old son and disappearance of his 2-year-old brother during a camping trip.

The court ordered that Kasey and Richard Klein Jr. of Zanesville be tried again. They had been sentenced to 12 years in prison for involuntary manslaughter last year.

Authorities said that the toddlers wandered away from the family campsite near the Muskingum River at Ellis Dam in 2011. The 3-year-old's body was found in the water. His half brother wasn't found.

The appeals court found that in defending Kasey Klein, her attorney prejudiced the jury against her husband by insinuating Richard Klein murdered the boys.

Because they were tried together, in granting Richard Klein a new trial, the judges wrote that they needed to do the same for Kasey Klein.

Messages left Tuesday for prosecutors were not immediately returned.
