Two central Ohio lawmen facing charges after the death of a suspected drunk driver are fighting those accusations in the second day of their trial in Delaware County.
The second day of the trial started with the prosecutor presenting their case against Ohio State Highway Patrol Trooper Sean Carpenter and Delaware County Sheriff’s Deputy Derek Beggs.
The prosecution spent the morning trying to prove that the man, Juarez-Popoca was drunk and the officers did not care when they left him at a Taco Bell in August.
Popoca later walked into a roadway, where he was struck and killed. A toxicology report showed Popoca had a metabolized alcohol level of .26.
10 Investigates first broke the story about how the deputies were caught on tape joking that they were going to take the undocumented Mexican immigrant to Taco Bell because the restaurant would a have a quote "translator."
On Friday, the jury heard a 911 call from the Taco Bell manager.
“I'm outside and I'm talking to you and I'm like walking around the back of my store and he's following me around. He's intoxicated,” said the manager.
“We actually, our guys just dropped him off. He's waiting on a ride. His ride should be there shortly to pick him up,” responded the dispatcher.
“Ok, well he's asking me to call police. So, I don't understand what he's saying and I can't get him to stop following me,” said the manager in the call.
Attorneys had not said if the law enforcement officers will testify in the case.
Deputy Christopher Hughes was one of the men also scheduled to face trial, but on Thursday he pleaded no contest to a minor misdemeanor on failure to assist a law enforcement officer.
