College Student Will Not Face Charges For Stabbing Intruder

A college student said that she was in the shower when a homeless man entered her apartment on Thursday.

Allison Rigel said it all started when she left her door unlocked because a friend was coming over.

"So, I went upstairs to shower and everything and got ready," Rigel said. "When I was on the third floor I thought I heard something but I just assumed it was a roommate."

When she walked downstairs, Rigel, 20, said that she noticed her door was open and her laptop was gone.

"(I) started checking through the house with the knife in my hand and my friend on the phone," Rigel said. "I found him on the second floor bedroom."

Police identified the man Rigel found as Derek Miller.

"Just as he got the door open I stabbed him in the back," Rigel said. "I fell backwards and couldn't chase him, so that's when I called the police."

Miller, 30, continued to run leaving a trail of blood behind him. Police caught up with him a short time later in a garage a short distance away.

Rigel said that she did not think twice about attacking the intruder.

"(I) kind of didn't have a choice," Rigel said. "(I) started looking, hoped it was just me imagining things. When it wasn't, I guess I just did what I had to do."

Miller was transported for medical attention and was expected to recover. He was charged with burglary. Police said that Rigel would not be charged.
