A hearing was planned for Monday afternoon on the state's plan to execute condemned killer Romell Broom, 10TV News reported.
Broom's first execution attempt was halted on Sept. 15 after executioners failed to find a usable vein after two hours of trying.
Broom's attorneys are suing to prevent a second execution attempt, arguing it would be cruel and unusual punishment.
The state has since changed its execution procedures from a three-drug intravenous lethal injection to a one-drug injection.
