A hearing planned for next month on the constitutionality of death penalty is on hold.
In an order filed Monday, U.S. Southern District Court of Ohio Judge Gregory Frost said both sides need more time before bringing the battle over the state's lethal injection system to court, 10TV's Andy Hirsch reported.
The hearing was scheduled prior to the September execution attempt of Romell Broom.
Broom's execution was postponed after executioners gave up after two hours of trying to find a usable vein for the lethal injection.
Judge Frost told 10TV Broom's case needs to be considered as potential evidence.
Broom's execution was stayed by Gov. Ted Strickland, along with two other inmates set to die, until the case is sorted out.
A new court date was set for July, and Ohio officials have already begun looking into changing the death penalty protocol.
