Legal Battle Brewing In Twin's Murder Retrial

Franklin County Common Pleas Judge Guy Reece approved $2,000 on Monday to hire another defense investigator to examine evidence in the upcoming trial of a man accused of killing his identical twin brother.

Prosecutors and defense lawyers met behind closed doors to discuss the second trial for Derris Lewis, 10TV's Maureen Kocot reported.

Police charged Lewis with murder after they discovered his bloody handprint on his brother's bedroom wall after the January 2008 slaying.

Prosecutors said that the bloody print discovered inside the Loretta Avenue home led them straight to Derris Lewis.

The defense team has argued that the print was not in blood and has said it wants it tested in a laboratory to prove as much.  If they can do that, the defense is hopeful that prosecutors would drop charges against Derris Lewis.

Witnesses said that Derris Lewis, 19, was not at his mother's home when Dennis Lewis was killed.  Police said that he was their only suspect based on the palm print on the wall where Dennis was shot.

"My mom bestowed love upon us," said Diane Lewis, their sister.  "That's all we had.  As far as trying to say that (Derris is) guilty, he never was guilty.  He's always been innocent."

Derris Lewis' first trial ended in a mistrial when a juror's sister-in-law died.  It will be up to a new jury to decide the teen's guilt or innocence.

"I'm 250 percent sure that my brother will walk out a free man," Diane Lewis said.
