Man Who Shot, Killed Alleged Burglar Could Face Charges
The Athens County Sheriff said on Monday that he does not believe a man who shot and killed an alleged burglar should be charged.
According to Sheriff Pat Kelly, a relative of the homeowner where the alleged burglary occurred on Thursday shot and killed 34-year-old Keith Rutter after he entered the home across the street from his.
Investigators said that the relative waited for Rutter to leave the home and then shot and killed him outside of the home.
So far, no one has been charged in the case, but Kelly said that he was getting pressure from the county prosecutor’s office.
“He is a man that lives in our county,” Kelly said. “He’s got a stable job, he’s got a family, he’s not a flight risk, and I just think we need to slow up and let the investigation go on. Let’s collect the facts and then we’ll present it to a grand jury.”
Charges may come down to whether the shooting was a deliberate act or a surprised response to the crime, Kelly said.
A grand jury did meet on Monday, but the prosecutor’s office would not comment on the proceedings.
