Man Refuses To Testify In Lewis Trial

Closing arguments are set for Wednesday in the trial of a Columbus teenager accused of killing his twin brother.

Derris Lewis, 19, is charged with aggravated murder in the killing of Dennis Lewis during an apparent home invasion, 10TV's Cara Connelly reported.

Defense attorneys on Tuesday tried to call a man to the stand who they said may have been Dennis' killer, but the judge would not allow him to testify after the man invoked the Fifth Amendment. 10TV will not report the man's name because he has not been charged in this case.

Then defense attorneys called Zack Rockwell to the stand. Rockwell testified that the man who refused to testify asked him to participate in a robbery shortly before Dennis, then 17, was killed in January 2008. Rockwell assumed the man was involved in Dennis' death.

But the prosecution was quick to try to discredit Rockwell, who under cross-examination said he never went to police with this information.

The defense rested its case Tuesday without calling Derris Lewis to take the stand in his own defense.

Prosecutors called two Columbus police detectives to refute earlier testimony by defense witnesses, including the assertion by Derris' sister Diane that the family found $283 in Dennis' room after police allowed the family back in the home.

Det. Thomas Burton said there was no money in the room when he searched the room as police conducted their investigation.

The cash is a crucial piece of evidence because prosecutors said Derris killed Dennis to take his money. The mystery for jurors is whether the money Derris and his sister said they found was overlooked by police, or placed there by someone after police left the scene.
