Man To Be Resentenced In Sexual Coercion Case
An appeals court panel has vacated the 17Â½-year prison sentence of an Ohio man who used Craigslist to arrange sex with someone he thought was a 14-year-old boy.
A three-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati on Tuesday ordered Kevin Weiner's case sent back to a federal judge for resentencing.
The court says the judge used the wrong sentencing guidelines and that the 44-year-old Columbus man faced only a maximum of 10 years.
Weiner agreed to plead guilty to sexual coercion and enticement of a minor. In exchange, the government didn't file charges related to three boys who said Weiner abused them.
Weiner was arrested in March 2011 after arranging sex with an undercover agent posing as a 14-year-old boy.
