The Fairfield County Clerk of Courts, currently under a theft in office investigation, has resigned.

Deborah Smalley is facing felony charges of theft in office. Her attorney's news release states that she expects to be formally indicted in January.

Smalley was the focus of an Ohio Auditor investigation after allegations were made that she required employees who work for her to campaign on county time.

The news release stated that Smalley "believes it is in the best interest of Fairfield County for her to resign, as opposed to continue contesting the motion filed in the Supreme Court of Ohio to remove her from office."

The release says the resignation is not a concession of guilt. It states she will spend time with family and friends and prepare for trial.
