Deputies Shoot, Kill Man Who Pointed Pellet Gun At Them
Marion County Sheriff's Deputies said they shot and killed a man who pointed a pellet gun at them Sunday night.
The Marion County Sheriff confirmed that the deputies responded to a domestic dispute between Byron Holveck and his girlfriend about 10 p.m.
Investigators said that Holveck, 40, had been allegedly firing shots about 8 p.m.
According to a news release on Monday afternoon, Holveck pointed a Gamo C02 pellet gun at the officers. The pellet gun had a close resemblance to a Walther PPK semi auto handgun.
Holveck’s girlfriend, Heather Nightwine, said that she called 911, because she thought it would be the answer to her problems of her boyfriend’s drunken rage.
Nightwine told 10TV News that Holveck had been drinking and was depressed over the anniversary of his wife’s death, money and job problems.
She said that she was never scared for her safety or the safety of her daughter, who she sent over to a neighbor’s home.
“I was trying to calm him down,” Nightwine said. “He was at his wit’s end."
When two deputies arrived, Holveck was in the front yard of the home, located in the 3200 block of Smeltzer Road, with the pellet gun.
Authorities said that when deputies ordered Holveck to turn around, he did so and pointed the pellet gun at them. Both deputies fired shots, Holveck was struck and killed.
"(I) just heard a bunch of commotion over there," neighbor Charles Hupp said.
Neighbors said they were not surprised deputies used force on him.
"It's just one of those things, I guess," neighbor Art Knickel said. "He gets in trouble every so often."
According to the sheriff’s office, Holveck had stated earlier in the day that he wanted to commit officer-assisted suicide.
Nightwine said that Holveck’s death has not sunken in yet.
“I don’t want to believe it,” Nightwine said. “This is not how he and I were supposed to end up.”
The deputies will be placed on administrative leave until the investigation is completed.
The Marion County Sheriff did not have confirmation whether Holveck fired the pellet gun at the deputies, who were uninjured.
