77-Year-Old Woman Killed, Grandson Charged In Attack

A 35-year-old south side man is charged with murder of his grandmother.

Timothy Smith was living with his grandmother when police say he called 911, alarmed that his grandmother wasn't breathing.

Caller: I've been checking on her all day. I just went to check on her and she's not breathing.
Dispatcher: Oh, she's not breathing?
Caller: No?
Dispatcher: OK
Caller: Oh my god.

Smith went on to tell the dispatcher,  "She's old she keeps falling down and smacking herself into (expletive) and I'm the only one in the family here to help her."

But detectives didn't buy the sorrowful plea for help and charged Smith the murder of his 77-year old grandmother Doris Durette.

Police aren't saying what the motive was behind the murder.

A next door neighbor tells 10TV they heard the two arguing last night but didn't know why, other neighbors voiced concern as well.

Records show Smith spent six months in prison in 1998 for carrying a concealed weapon.

Friends say he moved in with his grandmother at this south side apartment about three months ago after he said he and wife separated and his tree trimming business failed.

Neighbors say he referred to his grandmother as his mother because he said she raised him.
